Jovan was injured in a motor vehicle accident.  We assisted him with his claim and he was awarded a Judgment by the District Court an amount that did not reflect his full loss of earnings.  Consequently, we assisted Jovan to Appeal that decision and the Court of Appeal made a finding that the initial Judge had been wrong to use his own knowledge to make independent findings in respect of critical matters and should have instead made findings based on the evidence.  Accordingly, the Court of Appeal determined Jovan had suffered from a fundamental breach of procedural fairness and ordered the matter be returned to the District Court to reassess the amount of damages, where we procured a settlement of the matter with an appropriate outcome.
