Pierre v Hungry Jacks Pty Ltd & Competitive Foods Australia Pty Ltd https://www.caselaw.nsw.gov.au/decision/549ff4353004262463c5d57e

Pierre attended Hungry Jacks at Warwick Farm. When he sat down, the seat collapsed underneath him and he sustained substantial injuries and was unable to continue working.  As this was not a worker’s compensation or third party claim, Pierre was not entitled to any weekly insurance payments.  Accordingly, he struggled with financial difficulties as a result of having no income.

We were able to assist him to obtain a Judgment for an interim payment to tide him over until the claim fully resolved for a substantial and appropriate amount.  This part-payment option had not really been utilised by many applicants previously and we are proud to have been instrumental in the Court’s development of the principles to be applied when awarding interim payments.
